Ouistiti Maths — End User License Agreement (EULA)

This agreement (the "Agreement") governs your use of the Ouistiti Maths application (the "Application") on iPhone and iPad. It is presented and accepted on first launch, and can be read again at any time from the Application's Settings. By installing or using the Application, you accept the Agreement.
1. Parties
The Agreement is concluded between you and Éd's Monkeys Consulting (the "Publisher"), a French EURL (single-member limited liability company), SIREN 830 916 888, registered in Asnières-sur-Seine (92600), France. Publication director: Édouard RICHARD. Contact: ouistiti@edsmonkeys.co
Apple is not a party to the Agreement. The Agreement is concluded between you and the Publisher only, and not with Apple Inc. ("Apple"). The Publisher, not Apple, is solely responsible for the Application and its content. The Agreement may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions (the "App Store Terms") in force on the date you accept it.
2. License granted
The Publisher grants you a personal, non-exclusive and non-transferable license to use the Application on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the App Store Terms. The Application may also be used by other accounts associated with yours via Family Sharing or volume purchasing.
The Application is intended for personal and family, non-commercial use. Except where permitted by law, you may not rent, lend, sell, redistribute or sublicense the Application, nor copy, decompile, disassemble or attempt to derive its source code, nor create derivative works of it.
3. Family use, under an adult's responsibility
The Application is designed for children practising times tables and mental arithmetic. The adult who installs it accepts the Agreement on behalf of the child who uses it and remains responsible for that use.
The settings that commit the family (statistics, leaderboard participation, free-text nickname) sit in a parent area protected by a four-digit code chosen by the adult on their first visit.
The Application supports schoolwork, it does not replace it: the Publisher guarantees no learning outcome.
4. Free content and Ouistiti Pro
Free, with no time limit: learning and practising the times tables, the Challenge, mental arithmetic, leaderboards and the first three levels of the adventure.
Ouistiti Pro also unlocks levels 4 to 10 of the adventure, several child profiles on the same device and the choice of a free-text nickname. It comes in three forms, all granting the same access:
- Ouistiti Pro – Monthly: one-month subscription, renewed automatically;
- Ouistiti Pro – Yearly: one-year subscription, renewed automatically;
- Ouistiti Pro – Lifetime: one-time purchase, no renewal.
The price of each offer, including all taxes in your country's currency, is shown in the Application before any purchase is confirmed.
5. Subscriptions: payment, renewal, cancellation
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically for the same duration and at the same price unless cancelled at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription at any time in the device Settings › [your name] › Subscriptions. Cancellation takes effect at the end of the period already paid.
- Purchases follow your Apple Account and are available through Family Sharing. They can be restored from the Application's Settings ("Restore my purchases").
- Billing and refunds are handled by Apple under its own terms (https://reportaproblem.apple.com).
When a subscription ends, the progress already made is kept; only the features reserved for Ouistiti Pro become unavailable again.
6. Leaderboards and nicknames
Leaderboard participation is off until an adult turns it on from the parent area. Leaderboards show only a nickname and scores.
The nickname is drawn at random from vetted word lists. With Ouistiti Pro, the adult can type a free-text nickname, which is published exactly as entered. It must not contain a real name, contact details, or insulting, discriminatory or unlawful content. The Publisher may remove from a leaderboard any nickname that breaks these rules.
Turning leaderboards off deletes the scores already published.
7. Personal data
By using the Application, you agree that the Publisher collects and uses the technical data described in the Ouistiti Maths Privacy Policy (https://edsmonkeys.co/ouistiti-confidentialite.html). It details what stays on the device, what is sent, to whom, and how to exercise your rights.
8. Maintenance and support
The Publisher is solely responsible for providing maintenance and support for the Application, at ouistiti@edsmonkeys.co. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.
9. Third-party services
Some features rely on third-party services and an Internet connection: iCloud (Apple) for sync, Firebase (Google) for leaderboards and audience measurement, RevenueCat for purchase management. Their availability does not depend on the Publisher. You agree to comply with the terms of these services when you use them through the Application.
10. Warranty
The Publisher is solely responsible for any product warranties relating to the Application, whether express or implied by law, to the extent not effectively disclaimed. As a consumer, you benefit in particular from the statutory guarantee of conformity for digital content and services provided by French consumer law.
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application, if any. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Publisher.
Subject to the above, the Application is provided "as is". The Publisher does its best to keep it working properly, without any obligation of result, and may suspend some features for maintenance without notice.
11. Limitation of liability
To the extent permitted by law, the Publisher cannot be held liable for indirect damage resulting from the use of the Application or from being unable to access it. This limitation does not apply in case of gross negligence or wilful misconduct, to personal injury, or to consumer rights that cannot be waived by law.
12. Product claims
The Publisher, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with the Application's use of the HealthKit and HomeKit frameworks — which the Application does not use.
13. Intellectual property
All content of the Application (text, artwork, mascots, layout, sounds) is protected by intellectual property law and remains the exclusive property of the Publisher, unless stated otherwise. Any reproduction or representation, in whole or in part, without prior permission is forbidden.
In the event of any third-party claim that the Application or your possession and use of it infringes that third party's intellectual property rights, the Publisher, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
14. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
15. Termination
The Agreement remains in force until terminated. You may end it at any time by deleting the Application from your devices. Your rights under the Agreement terminate automatically if you fail to comply with its terms. Upon termination, you must cease all use of the Application.
16. Third-party beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of the Agreement, and that, upon your acceptance of the Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce the Agreement against you as a third-party beneficiary thereof.
17. Changes to the Agreement
The Publisher may change the Agreement. The date of the last update is shown at the top of this page. In the event of a significant change, the new text is presented in the Application.
18. Governing law and disputes
The Agreement is governed by French law. In the event of a dispute, please first contact the Publisher at ouistiti@edsmonkeys.co to seek an amicable solution.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, you may also refer the matter free of charge to a consumer mediator, whose details are provided on request at the same address.
Failing agreement, the competent French courts shall have sole jurisdiction, without prejudice to the mandatory consumer protection rules of your country of residence.
